2. Scope
These T&C apply to the sales contract between the seller and the buyer who places an order in the webshop. The language of the contract is Hungarian. The contract is deemed a written contract; the seller files it electronically and makes it available to the buyer through the order confirmation. The seller is not subject to any code of conduct.
Matters not regulated in these T&C are governed by Hungarian Act V of 2013 on the Civil Code (Ptk.), Act CVIII of 2001 on electronic commerce services and Government Decree 45/2014 (II. 26.) on detailed rules for contracts between consumers and businesses.
3. Products and prices
The webshop sells contemporary artworks. Most artworks are unique, one-of-a-kind pieces; the photos on the product pages are faithful, though colours may vary slightly depending on screen settings.
Prices shown on the product page are in euros (EUR) and are the final price payable by the buyer; no packaging or delivery fees are charged. The seller reserves the right to change prices, but orders already placed are subject to the price valid at the time of ordering. In the case of an obviously incorrect price (e.g. EUR 0 or a price significantly different from the usual price), the seller is not obliged to sell the product at the incorrect price, but will offer the purchase at the correct price.
4. How to order
1. The buyer adds the selected artwork to the cart.
2. At checkout, the buyer enters their name, e-mail address, phone number and billing address.
3. As the payment method, the buyer selects “Személyes fizetés a galériában” (payment in person at the gallery) and collects the artwork in person at the gallery.
4. Before pressing the “Place order” button, the buyer checks and, if necessary, corrects their details and accepts the T&C.
5. By pressing the “Place order” button, the buyer makes an offer involving an obligation to pay.
The seller immediately confirms receipt of the order by automatic e-mail. If the confirmation does not arrive within 48 hours, the buyer is released from the offer. The contract is concluded when the seller confirms the availability of the artwork by e-mail or phone and arranges the time of collection.
As the artworks are unique, a piece may have been sold in the gallery in the meantime. In this case the seller notifies the buyer without delay, and no contract is concluded.
5. Collection and payment
Collection:
in person only, at the gallery (1088 Budapest, Bródy Sándor u. 22.), during opening hours or at an agreed time. There is no home delivery.
Payment:
on collection, in cash. There is no online payment, and no card details are entered on the website.
Collection deadline:
the artwork must be collected within 14 days of the confirmation, unless otherwise agreed. If collection does not take place through the buyer’s fault, the seller may withdraw from the contract.
The seller hands over the invoice on collection.
6. Right of withdrawal
A buyer who is a consumer may withdraw from the contract without giving any reason within 14 days of receiving the product, under Government Decree 45/2014 (II. 26.). The right of withdrawal may also be exercised between the conclusion of the contract and the receipt of the product.
The easiest way to withdraw is with the “Online withdrawal” button in the website footer, on the online withdrawal page . Withdrawal can also be communicated by e-mail (amprojects.space@gmail.com) or by post with a clear statement; the buyer may also use the model withdrawal form in Annex 2 of the Decree. The seller confirms withdrawals made on the online page by e-mail without delay. The withdrawal is deemed to be made in time if the buyer sends the statement before the deadline expires.
In the event of withdrawal, the buyer must return the artwork to the gallery or send it back to the seller without delay, and at the latest within 14 days of communicating the withdrawal; the cost of return is borne by the buyer. The seller refunds the price paid within 14 days of the withdrawal, but may withhold the refund until the artwork has been received back. The buyer is liable for any diminished value of the artwork resulting from handling beyond what is necessary to establish its nature and characteristics.
The right of withdrawal does not apply to artworks made specifically to the buyer’s individual order.
7. Warranty
Warranty for defects (kellékszavatosság):
in the event of defective performance by the seller, the buyer may request repair, replacement or a price reduction, or may withdraw from the contract, under the Civil Code. In consumer contracts, a defect discovered within one year of receipt is presumed to have existed at the time of receipt. Claims expire two years after receipt.
Product liability (termékszavatosság):
for artworks, the liability of the producer/distributor can be enforced under the Civil Code.
The buyer can inspect the artwork at the gallery on collection; any visible damage should be reported at that time.
8. Complaints and remedies
The buyer can submit a complaint to amprojects.space@gmail.com , by phone (+36 30 300 8019), by post to the registered office or in person at the gallery. The seller responds to written complaints on the merits within 30 days and keeps the complaint and the response for 3 years.
If the complaint cannot be resolved, the consumer may turn to the conciliation board competent for their place of residence. The board competent for the seller’s registered office is:
Budapest Conciliation Board (Budapesti Békéltető Testület):
1016 Budapest, Krisztina krt. 99., Hungary
Phone: +36 1 488 2131
E-mail: bekelteto.testulet@bkik.hu
Website: bekeltet.bkik.hu
The consumer may also turn to the consumer protection authority of their place of residence (county government office) or to the courts.
9. Copyright
Images, texts and reproductions of artworks on the website are protected by copyright. Purchasing an artwork transfers ownership, but not the copyright (e.g. the right of reproduction), which remains with the artist.
10. Data protection
The processing of personal data related to orders is described in the Privacy Policy .
11. Changes to the T&C
The seller may amend these T&C; amendments take effect when published on the website and apply to orders placed after that date.
